Our Terms and Conditions

General

Products available for Cocoon Play Concepts are for domestic and commercial use. If any part of these terms and conditions is found to be void, invalid or otherwise unenforceable, then that part shall be deemed to be superseded by a valid, enforceable provision that matches the intent of the original provision as closely as possible. The remainder of these terms and conditions shall continue to be enforceable and valid.

Made to order stock

Paid orders for products which are made to individual customer specification, including custom made furniture products which have to be ordered specifically for a customer cannot be cancelled or returned if the customer decides the customer no longer want the products.

Payment

The buyer will pay to Cocoon Play Concepts a non-refundable deposit of 50% of the total cost on order of the goods. The outstanding 50% will be invoiced once goods have been manufactured, before they are shipped from Italy.

Freight costs will be negotiated and invoiced separately dependent the purchaser’s requirements.

No payment shall be deemed to have been received until Cocoon Play Concepts has received the appropriate cleared funds.

If the goods are not available for delivery for any reason a refund or credit for the invoiced amount will be offered to the buyer.

Price

Unless otherwise agreed by Cocoon Play Concepts in writing, the price for the goods will be the price published on a written quote.

All published quotes are valid for 30 days.

The quote for the goods shall be exclusive of any costs or charges in relation to GST, freight and delivery, all of which amounts the purchaser shall pay upon issue of an invoice.

Discounts are also offered for large orders and are negotiated by Cocoon Play Concepts with the purchaser.

Storage

You must take delivery of the products within 14 days from the day that we notify you that they are available. If products are not delivered in this timeframe, storage fees may apply.

 

Delivery

All goods are owned by Cocoon Play Concepts until the invoice is paid in full.

Unless otherwise agreed in writing, delivery of the goods shall take place to the address provided by the purchaser. Correct delivery and access details are important and will be confirmed upon confirmation of any order.

All delivery dates are estimates only, as they are dependent upon production and weather conditions. Cocoon Play Concepts will ensure ongoing communication to the purchaser, regarding manufacturing and shipping milestones.

The purchaser is responsible for providing clear access to the property and for any machinery such as forklifts for large orders.

Risk/ Title

From the date of delivery the purchaser owns the goods.

Any future damages will need to be covered by the purchaser’s insurance except where Cocoon Play Concepts agrees to a warranty issue.

Quality/ Warranty

All goods are subject to testing and checking by Cocoon Play Concepts and arrive to the purchaser checked and fit for their purpose.

Cocoon Play Concepts will provide a “Handover Manual” to the purchaser before delivery, outlining Product Information; Care Instructions and relevant Risk-Benefit Detail.

Upon delivery, the purchaser will receive an ‘Arrival Checklist’ and asked to complete and return to Cocoon Play Concepts within 2 days.

The purchaser must check immediately on arrival all goods are in working order and have no defects. The purchaser must give written notice (Arrival Checklist) of any defects to Cocoon Play Concepts immediately on arrival of the goods. Cocoon Play Concepts must be notified within 48 hours of the goods being delivered.

Non-return of this checklist means to our company, that the purchaser agrees that the goods are in good working order.

Cocoon Play Concepts must be given a reasonable opportunity after receiving such notice of examining such goods and will communicate with the purchaser to resolve such issues. The purchaser will be notified of the outcome in due course.

Any goods replaced or repaired shall be guaranteed for the unexpired portion of the warranty period.

Cocoon Play Concepts shall not be liable for any breach of any warranties by the purchaser. This includes when a defect arises because the purchaser failed to follow Cocoon Play Concepts for Children oral or written instructions as to:

  1. Repairs to the goods are made or attempted by a service provider other than one approved by Cocoon Play Concepts.
  2. The product has not been used or maintained in accordance with the manufacturer’s instructions as provided with the product and/or any relevant care instructions.
  3. The customer uses the product in an abnormal manner for example if the product is abused, misused, dropped, crushed, impacted with any hard surface, exposed to extreme heat (including fire) or cold, not maintained properly or used after partial failure.
  4. The product has ben modified, incorrectly adjusted or operated, subjected to incorrect electrical supply or inconsistent electrical supply or used with inappropriate accessories.
  5. The product is tampered with in any way.
  6. The product’s safety tag, serial number or other tags as applied by the manufacturer has been altered or removed from the product.

Force Majeure

Cocoon Play Concepts reserves the right to defer the date of delivery or to cancel the goods or reduce the volume of the goods ordered by the purchaser (without liability to the purchaser) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control. This includes without limitation, acts of God, governmental actions, emergency situations, labour disputes, restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.
